Delivery and returns

§ 1. DEFINITIONS

1. Consumer - a natural person making a legal transaction not directly connected with his/her economic or professional activity;

2. Entrepreneur Consumer - a natural person conducting business activity on the basis of an entry in the Central Register and Information on Business Activity (including a partner in a civil partnership), concluding a contract directly related to his/her business activity, when it follows from the content of the contract that it does not have a professional character for that person, resulting in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.

§ 2. WITHDRAWAL FROM THE SALES CONTRACT

1. 1. The Seller informs that pursuant to Article 27 of the Act of 30 May 2014 on Consumer Rights, a Buyer who is a Consumer or a Consumer Entrepreneur may withdraw from a sales contract concluded with the Seller except in the cases indicated in Article 38 of the Act of 30 May 2014 on Consumer Rights (withdrawal is not possible, inter alia, when the purchased item serves to satisfy the individualised needs of the Buyer who is a Consumer or a Consumer Entrepreneur).

2. 2. Withdrawal from the sales contract does not require any reasons to be given and the Buyer who is a Consumer or a Consumer Entrepreneur shall not bear the costs related thereto, except for incurring the direct costs of returning the item to the Seller

2. 3. If the Buyer who is a Consumer or a Consumer Entrepreneur has the right to withdraw from the sales contract, it is sufficient for him to inform the Seller of his decision within 14 days by sending an e-mail to: waw@centrumkas.pl. A Buyer who is a Consumer or a Consumer Entrepreneur may also use the model declaration of withdrawal from the sales contract located - here. The time limit for withdrawal from a sales contract shall commence from the taking possession of the item by the Buyer who is a Consumer or a Consumer Entrepreneur or a third party other than a carrier indicated by such Buyer, and in the case of a sales contract which:

1. 1. 1. consists in multiple goods which are delivered separately, in lots or in parts - from taking possession of the last good, lot or part thereof, 
      2. consists in the regular supply of goods during a defined period of time - from taking possession of the first item.

Sending the declaration before the expiry of the aforementioned deadline shall suffice to meet the deadline.

2. 4. Any payments made by the Buyer who is a Consumer or a Consumer Entrepreneur (including the costs of delivering the item) shall be refunded to the Buyer who is a Consumer or a Consumer Entrepreneur immediately, but no later than within 14 calendar days from the date of receipt by the Seller of the declaration of the Buyer who is a Consumer or a Consumer Entrepreneur on withdrawal from the sales contract.

2. 5. The Seller shall refund the payment using the same method of payment used by the Consumer Buyer or Consumer Entrepreneur, unless the Consumer Buyer or Consumer Entrepreneur has expressly agreed to a different method of refund that does not incur any costs for the Consumer Buyer or Consumer Entrepreneur.

2. 6. The Seller may withhold reimbursement of payments received from a Consumer Buyer or a Consumer Entrepreneur until the Buyer who is a Consumer or a Consumer Entrepreneur has received the item back or the Buyer who is a Consumer or a Consumer Entrepreneur has provided proof of return, whichever event occurs first - unless the Seller has offered to collect the item himself.

2. 7. A Buyer who is a Consumer or a Consumer Entrepreneur is obliged to return the item to the Seller or hand it over to a person authorised by the Seller to collect it immediately, but no later than 14 days from the day on which he withdrew from the sales agreement, unless the Seller offered to collect the item himself. It is sufficient to send the item back before the expiry of the aforementioned deadline.
